Ninth Circuit Slaps Down Activist Judge, Greenlights Tear Gas for Portland ICE Riots

The radical left's latest attempt to handcuff federal agents just got crushed.

In a 2-1 decision, the Ninth Circuit issued an administrative stay reversing U.S. District Judge Michael Simon's February order that banned tear gas and crowd control munitions at Portland's ICE facility. Agents can now defend the building as "No Kings" protesters gear up for another round of chaos this weekend.

Simon, married to anti-ICE Democrat Rep. Suzanne Bonamici, had slammed the Trump administration as an "authoritarian regime" in his ruling. Critics slammed the obvious conflict of interest and judicial overreach that would have left officers exposed while Antifa-linked agitators turned the streets into a war zone.

Portland's ICE site has been a magnet for violence since the 2018 riots, with "No Kings" demonstrations often escalating into property damage, assaults on law enforcement, and taxpayer-funded mayhem pushed by progressive donors. Simon's order tied agents' hands, demanding "imminent threat" before any response and ignoring the real-world mobs refusing dispersal orders.

The appeals court hit pause just in time. Law and order wins this round. Federal officers should protect America's borders and buildings without activist judges playing defense for the rioters. No more special treatment for the No Kings mob.
